Second Circuit Hears Arguments on Constitutionality of DOMA

Opposing counsel fielded questions Thursday from the Second Circuit on the degree of scrutiny the federal appeals court should apply to the Defense of Marriage Act, with one side arguing for rational basis scrutiny and the other arguing for a heightened form of scrutiny with the proviso that the law should be overturned under either approach.
