Arnold Schwarzenegger has appeared in his first interview since he dropped the bombshell about his “love child” with his former housekeeper.

The actor and former California Governor discusses his infidelities and reflects on his life on the road to becoming famous in his upcoming autobiography, “Total Recall: My Unbelievably True Life Story.”

Arnold agreed to an interview with Lesley Stahl for “60 Minutes” to promote his new book.

Lesley asked about the actor’s cheating on Maria Shriver, asking “So you lied to her?”

“You can say that,” responded Schwarzenegger.

“She gave up her television career for you…” Stahl said, asking “was this just the most unbelievable act of betrayal, to Maria?”

This was a word Arnie didn’t feel comfortable using apparently.

The action star also admits in his book that he had a “hot affair” with actress Brigitte Nielsen while they filmed “Red Sonja” in 1985 when he was already living with Maria Shriver.

Schwarzenegger, now 65, never thought the relationship with Nielsen was serious and that the fling actually convinced him to marry Shriver.

The interview with Schwarzenegger is on tonight on “60 Minutes”.

The book will be released Monday, Oct. 1, from Simon & Schuster, a company owned by CBS.

Kate Gosselin Abuse Allegations Surface!

Allegations that Kate Gosselin is an abusive parent have once again surfaced and this time there could actually be proof.

Reporter Robert Hoffman is making some serious allegations against the reality TV mom. According to RadarOnline Robert is claiming that Kate beat her kids with a wooden spoon as well as yanking the kids around by their hair. Along with that he accuses the Kate Plus 8 star of punishing her children for minor things like trying to climb out of their crib and not getting the jist of potty training quick enough for her liking.

If those accusations aren’t enough it gets worse. Allegedly Hoffman has found secret journals that Gosselin used to help her wrote her two books, Multiple Bles8ings and EightLittle Faces. The notes are apparently very damaging and could actually be the proof that she abuses her kid. Allegedly one journal entry talks about how when a couple of the kids ate M&M’s without permission she pulled them by the hair and spanked them really really hard. Another entry tells the story about one day when son Colin threw a hissy fit, like all kids do, she pulled him up by the hair and whipped him into his crib, she even goes to say to that day she really thought she might hurt her own child. Some seriously that is some scary shiz and I sure hope someone is taking these accusations seriously. As you can tell by the couple journal entries that were stated above it kind of seems like the journals are from when the kids were younger. I would certainly hope she doesn’t have any of them sleeping in a crib.

Along with the RadarOnline story Star magazine has made Kate their cover story for the week with similar accusations. The story talks about the abuse, Kate’s wild drunken nights out you know that kind of juicy stuff that may or may not be considering the source and by that I mean the tabloid magazine. Considering that I am so not a fan of Gosselin I find myself wondering what is really true. Usually i am all about being a hater when it comes to her but considering the nature of these allegations I am going to reserve my normal negative Kate bashing right now. That being said here is hoping that the truth about what kind of parent she is comes out soon for the sake of her kids. Perphas TLC might have some behind the scenes footage that could tell viewers if she really is an abusive paretn, just sayin.

This is one hot and sensitive topic and I want to hear your two cents on it.

Giving photographers a smile and a wave, AnnaLynne McCord dined out on Saturday night (September 29), as she was spotted leaving the Pink Taco restaurant in Hollywood.

The "90210" star wore a pretty pink sleeveless top, skinny black jeans, and black heels. She was out and about to party with co-star Shenae Grimes and the rest of cast, celebrating the show's 100th episode.

Just last week, the 25-year-old actress hosted the Life is Love event in L.A., benefiting the Somaly Mam Foundation, a group seeking to end global human trafficking and slavery.

During her emotional speech, she shockingly opened up about her own past sexual assault. On stage the starlet asked, "Has anyone ever been raped? Sexually abused? Not said 'no' when you felt you didn't have the right to? I know what it feels like."

She later explained to E! News that "It happened to me once by somebody that I knew, and it is a very interesting thing to feel that you do not have the voice to say 'no.' It wasn't an attack or anything like that—I just had no voice. I did not know how to say, 'I don't want this. Please do not do this to me.'"

Eleventh Circuit Reverses In Part Securities Fraud Judgment Against Clearing Broker in an Action Brought by the SEC

In Securities & Exchange Commission v. Goble, 2012 WL 1918819 (11th Cir. May 29, 2012), the United States Court of Appeals for the Eleventh Circuit held that the recording of a sham transaction in the corporate books did not constitute “securities fraud” in violation of Section 10(b) of the Securities Exchange Act of 1934 (“Exchange Act”), 15 U.S.C. § 78j(b), and Securities & Exchange Commission (“SEC”) Rule 10b-5, 17 C.F.R. § 240.10b-5, because “a misrepresentation that would only influence an individual’s choice of broker-dealers cannot form the basis for § 10(b) securities fraud liability.” In so holding, the Eleventh Circuit declined “the SEC’s invitation to expand [the] definition of materiality” to capture the misrepresentation.

Richard Goble founded and controlled North American Clearing, Inc. (“North American”), a clearing broker for about forty small brokerage firms which cleared transactions for more than 10,000 customer accounts valued at more than $500 million. During late 2007 and early 2008, North American faced declining revenues, and allegedly struggled to meet its operating expenses and make required contributions to its cash reserve account as required by SEC regulations. Finally, in May 2008, Goble directed the CFO of North American to record a sham transaction — a $5 million money market purchase — to make it appear that North American could withdraw $3.4 million from its cash reserve account. Financial Industry Regulatory Authority, Inc. examiners discovered a discrepancy created by the sham money market purchase and demanded an explanation. An SEC enforcement action followed, charging that North American violated the Customer Protection Rule under Section 15(c)(3) of the Exchange Act, 15 U.S.C. § 78o(c)(3), codified in SEC Rule 15c3-3, 17 C.F.R. § 240.15c3-3, and the Exchange Act’s books and records requirements under Section 17(a) of the Exchange Act, 15 U.S.C. § 78q(a), codified in SEC Rule 17a-3, 17 C.F.R. § 240.17a-3. The SEC also charged Goble with violating Rule 10b-5 (in addition to aiding and abetting the firm’s alleged securities law violations).

The SEC settled with North American, but not Goble personally. After trial, the United States District Court for the Middle District of Florida held that Goble’s actions concerning the sham money market transaction violated Section 10(b) and Rule 10b-5 (in addition to aiding and abetting the firm’s violations). The district court enjoined Goble from future violations of the securities laws and permanently restrained him from seeking a securities license or engaging in the securities business.

On appeal, the Eleventh Circuit reversed the district court’s judgment on the Section 10(b) count, upheld the judgment on the aiding and abetting count and remanded for reconsideration of the injunctive relief and the bar.

The Eleventh Circuit “easily dispatched” the SEC’s allegation that Goble’s recording of a sham transaction was a “material misrepresentation” under the Exchange Act. The Court held that the materiality test focuses on whether a reasonable person would attach “importance” to the fact misrepresented in determining a “course of action.” The Eleventh Circuited noted that it understood this “course of action” to mean an “investment decision — not an individual’s choice of broker-dealers.” Thus, “a misrepresentation that would only influence an individual’s choice of broker-dealers cannot form the basis for a §10(b) securities fraud liability.” The Eleventh Circuit also held that even if Goble had made a “material misrepresentation,” that misrepresentation was not made “in connection with the purchase or sale of securities,” even though it assumed, without deciding, that the money market fund was a security. The Eleventh Circuit also noted that even though the United States Supreme Court has instructed that Section 10(b) be construed “flexibly to effectuate its remedial purposes” (SEC v. Zandford , 535 U.S. 813, 819, (2002)), Goble did not engage in an actual “purchase” of a security for purposes of Section 10(b). Since the only “purchase” was a sham transaction, it was neither a “purchase” nor “the type of fraudulent behavior which was meant to be forbidden by the statute and the rule.”

This decision reflects than an investor’s choice of broker-dealer is not “material” because it does not relate to an “investment decision.” In so holding, the Eleventh Circuit constricted the reach of Section 10(b) of the Exchange Act and tightened the standards for issuing an injunction, precluding “obey the law” orders which have long been a staple of SEC enforcement.

Commission names four finalists for Hennepin County

The Commission on Judicial Selection has named four finalists for two open seats on the bench in Hennepin County.  The vacancies arise from the retirements of Judge Lucy Wieland and Judge David Duffy.  The finalists are:

Andrew Dunne –Dunne is an assistant United States attorney for the district of Minnesota where he handles federal criminal law matters. He has held a variety of positions with the United States attorney’s office, including serving as chief of the criminal division and senior litigation counsel.  Dunne is a senior training instructor with the Department of Justice’s Office for Overseas Prosecutorial Development and Training program, where he teaches judges and prosecutors in a variety of countries. He is also an adjunct professor at the University of St. Thomas law school and the University of Minnesota law school. 

Hilary Lindell Caligiuri –Caligiuri serves as a senior assistant Hennepin County attorney where she supervises the drug unit within the community prosecution division. She previously worked as an assistant attorney general and then deputy attorney general for the state of Minnesota, overseeing the criminal trial division and later the government services section of the attorney general’s Office.

James Moore –Moore currently serves as the litigation manager of the civil division for the city of Minneapolis where he is responsible for assigning and supervising all litigation for the city. He previously worked as an assistant city attorney for the civil divisions of both Minneapolis and Bloomington.

Kristin Siegesmund –Siegesmund works with Mid-Minnesota Legal Aid where she serves as a managing/supervising attorney for multiple divisions including most recently the consumer and tax units and previously the housing and housing discrimination Units.  She previously worked as a staff attorney with the Minnesota Disability Law Center and was an associate commercial litigator at Faegre Baker Daniels, LLP. Siegesmund has taught numerous courses at William Mitchell College of Law.

Baugh leaving capital defender job

The capital defender for the central region of Virginia, David Baugh, has quit the post, according to reports.

On his Facebook page, Baugh alludes to a “humiliating” event on Thursday, using the word “betrayed,” and states, “I have resigned as capital defender and am returning to private practice.”

Efforts to reach Baugh were unsuccessful. WTVR reported that it confirmed Baugh’s resignation through his friends.

Baugh was appointed capital defender in 2008. He had a private criminal defense practice from 1983 to 2008. He received the Virginia State Bar’s Lewis F. Powell Jr. Pro Bono Award in 2006. Virginia Lawyers Weekly honored him as a “Leader in the Law” in 2008.

In his new book, the muscle man reveals all the Red Sonja heat they shared back in 1985.

He was living with Maria Shriver at the time... Brigitte claims she knew nothing of the relationship.

This is just one of the many times Arnold "inflicted tremendous pain" on the woman who gave up her career for him. Bleh...

Erlinder charges WMCL with discrimination based on disability

Erlinder

Professor Peter Erlinder has filed a charge of discrimination with the EEOC against William Mitchell College of Law.

A copy of the charge was mailed anonymously to Minnesota Lawyer, with no note or cover letter.

Erlinder claimed discrimination based on disability and retaliation because he has post-traumatic stress disorder. His PTSD stems from his imprisonment in Rwanda in 2010 and subsequent death threats from  Rwanda’s President Kagame.  He is undergoing treatment and has medication.

He alleged that William Mitchell has been a hostile work environment since he returned from Rwanda.

He stated that he suffered a PTSD episode on Jan. 3, 2012  and that on Jan. 12 Dean Eric Janus ordered him off the campus.  On Jan. 13 he was escorted off the campus by an armed guard, he said.

Janus told Minnesota Lawyer that the school takes its obligations under the ADA “very very seriously and “vigorously denies the allegations of hostile work environment or retaliation.” He said he could not further discuss personnel or employee’s medical matters, but that the school has conducted its own investigation.

Karlie Kloss Works Up a Sweat in the City of Lights

After working the runway at the Lanvin Spring/Summer 2013 show as part of Paris Fashion Week at Les Beaux Arts de Paris, Karlie Kloss took time to keep her svelte figure looking great with a Friday afternoon (September 28) workout.

First, the 20-year-old model loosened up with some running in a black long-sleeved top and cute pink running shorts with matching tennis shoes. Then, she released some aggression with some boxing with her trainer.

Karlie posted a photo to her Twitter account of her scenic view with an accompanying message reading, "Afternoon workout under the Eiffel Tower."

Erin Moran, the actress who was only 14 when she signed on to the hit show “Happy Days” to play the role of Joanie Cunningham, is now haggard and homeless.

Moran, 51, was photographed looking worse for wear outside of a Holiday Inn in Corydon, Indiana, after she was kicked out of the trailer house she shared with her husband Steve Fleischmann.

Erin had been kicked to the curb by her mother-in-law, who was sick and tired of the star’s “hard-partying” lifestyle.

It was reported in June that Erin and her husband had moved into a rundown trailer park after they lost their California home that went into foreclosure.

A family friend said of the situation, “Erin was going out to bars and coming home at all hours of the night, sometimes with her rowdy bar friends, and Steve’s mom just couldn’t take it anymore.”

Moran played the squeaky-clean Joanie in the sitcom “Happy Days”, which started in 1974 and ran for nearly ten years.

Erin Moran reprised her role in 1982 in her spinoff with Scott Baio, entitled “Joanie Loves Chachi” until its cancellation the following year.

Since that time, Moran’s career has been non-existent, but was featured on the reality show “Celebrity Fit Club” in 2008.

Moran and her husband are now reportedly living off her payout from a lawsuit filed by several “Happy Days” cast member in 2011.

The lawsuit claimed cast members had not received money from the merchandising revenues they were owed under their contracts.

In July 2012, Erin and her co-stars settled their lawsuit with CBS with each receiving a payment of $65,000 and a promise by CBS to continue honoring the terms of their contracts.

Fox News made a little boo-boo today as they were airing a car chase through rural Arizona live, ending in the carjacker committing suicide on the air!

Shepard Smith, the anchor on Fox News, was on the air as cameras followed the pursuit of the man in what was their second car chase of the day.

After almost an hour, the Dodge Caliber is shown pulling onto a dirt road and the suspect made his way out of the vehicle with a gun in his hand.

Cameras were rolling as the man ran as if someone was chasing him before stopping and shooting himself in the head.

Host Shepard Smith began yelling “get off it” as soon as he realized what had just been aired accidentally.

After the commercial break, Smith apologized for accidentally airing the suicide. Fox tried to cut away in time, but things happened so quickly.

Smith stated, “We really messed up… and we are all very sorry.”

“That didn’t belong on TV,” Shepard stated. “We took every precaution we know how to take to keep that from being on TV. And I personally apologize to you that that happened.”

"Seven days after my campaign began, the whole planet is talking about me," Mirad Hadziahmetovic told Reuters. "I think I have had a super campaign and proved to be the best market expert in Bosnia."
The self-proclaimed "innovator" had been running as an independent candidate for mayor of Zenica, the fourth-largest city in Bosnia with a predominantly Muslim population, in the October 7 ballot.
The innovative marketing?
The election commission removed him from the race last week over pornographic material accessible on his campaign web page.

After each question visitors to his web page posed about local election issues, they were allowed to proceed to links with pornographic content, which had to be removed after the commission's decision.
Hadziahmetovic appealed against what he said was a "shameful decision" to Bosnia's state court this week and voiced confidence that it would be overturned.
Add "eternal optimist" to "market expert" and "innovator."
Unless he is re-instated as a candidate, he will file a suit to the Strasbourg-based European Court of Human Rights, he said.
In an open letter asking for support from Western ambassadors in Bosnia, Hadziahmetovic said he only wanted to turn Zenica into a Hollywood instead of a Tehran.
"I know boys and girls in my country want to make love freely, have fun and enjoy life. They all dream of Hollywood, not Tehran," he wrote, refering to Zenica's current mayor, who comes from a Bosnian Muslim party with post-war links to Iran.

Leighton Meester And Hugh Laurie Love Each Other In 'The Oranges' Exclusive Red Band Clip

Here's a premise you probably never thought you'd hear: Leighton Meester and Hugh Laurie fall in love in a relationship that wreaks havoc on both of their families. But that's exactly what the comedic film "The Oranges" is about.

The movie is finally getting a theatrical release starting October 5, and MTV News is delighted to have an exclusive clip to present in anticipation of that date. Be warned, there is some inappropriate language in the video. It also will generate some terrible mental imagery, and we just read about bagel foreheads, so you know we're being serious. But the clip gives us a good sense of what we can expect from this little indie, which has one of the most exciting casts we've seen in a while.

In addition to Meester and Laurie, there's a delightful array of comedic talent at play here. Allison Janney and Oliver Platt play Meester's character's parents, while Katherine Keener is the wife of Laurie and Alia Shawkat plays his daughter. Adam Brody and Aya Cash round out the cast.

"The Oranges" tells the story of the Wallings (Laurie and Keener) and the Ostroffs (Platt and Janney), two families who are neighbors and best friends living on Orange Drive in New Jersey. All is well in their lives until Nina Ostroff (Meester) returns home after a five year absence and enters into an affair with David Walling (Laurie), throwing the lives of everyone around her into upheaval -- especially that of her childhood best friend Vanessa Walling (Shawkat).

The rewind button didn't even mind that we were wearing it out!
