Plaintiffs Strike Out Again in BP Shareholder Litigation

The U.S. Court of Appeals for the Fifth Circuit has killed off a shareholder derivative case against BP plc over the Deepwater Horizon oil spill, extending a winning streak for BP in investor litigation over the catastrophe. The court ruled that a district court judge didn't clearly err when he ruled that the claims should be heard in the United Kingdom, not the United States.
