Listen to them (clients), acknowledge what they have said (“active listening”), make sure you understand their concern/pain, and address it (their concern) effectively (competent representation per the rules of professional conduct)...”  Sounds like a formula for success.

Sarah, if you awoke tomorrow to discover you were Bruce Willis, what's the first thing you would do?

Oh my god, that's so easy! I would just walk around all day yelling "Yippee-Ki-Yay Motherfucker!"

What was your favorite Buffy episode to work on?

I have a few, so bear with me... My first one is The Prom because I just love that whole story, and I thought it just encapsulated the show so well. It was beautiful and heartbreaking... I also love Hush because I think it's not just the scariest episode we've ever done but the challenge to do a silent episode - I thought it would be easy but it was way harder... And the other favorite I love is The Body, because it was beyond difficult and heart wrenching to shoot, and I don't know if many people know this, but my entire first scene was all done in one take. It was 4-5 minutes of one long take.

If you could create an alcoholic drink based on anything in the Buffyverse, what would you call it and what would be the ingredients?

A fruit punch mouth! And what's in it? A red punch with rum.

How many times did you accidentally stab yourself on the set of Buffy? What did James Marsters' hair feel like? How did David Boreanaz smell?

Oh please?!? How many times do I hurt myself getting out of bed? For a pretty graceful person I'm a klutz... Ha! Well at the time on Buffy, over-processed. As any woman knows what it's like... I can say that David honestly smells very good and continues to smell very good. I apologize to Jamie his wife for answering that question.

What's the weirdest experience you've had while meeting a fan ?

"It's never weird. It's usually a really exciting experience, except when it happens in the bathroom. I prefer it not to happen there."

If you could make any book into a movie or television show, what would it be?

"It's hard for me because books live so much in my imagination that sometimes I like them to stay there. But I would love to see the Secret History."

Star Wars or Star Trek?

"UM EXCUSE ME MY HUSBAND IS A JEDI."

Is Alyson Hannigan as cool in person as she looks in the show?

"They all were. That's what was so great about the show. Everybody was so unique and brought so much personally and professionally. And she's pretty funny."

What’s Robin Williams like off camera--is he always “on?”

"NO. That's the funny thing. Is that he's such a down to earth person that sometimes you have to ask him to turn it on!"

"ANGEL"

What was your favorite "big bad" throughout Buffy?

Ohhhh! I loved a couple. When Angel turned bad. Physically I think the scariest were the guys from Hush. And also Camden Toy, I can't think of his character's name right now. And I also liked it when I was the bad guy. And while we're on this topic, I remember my other favorite episode, even though no one asked: I also liked the body switching episode where I got to play Faith and Faith got to play Buffy.

What's your favorite song at the moment?

Let it Go from Frozen. That and I hear Wicked all day long every day because my daughter is obsessed. And any song Auntie Kristin sings is good by her.

What kind of steps do you take to make sure your relationship stays private? What kind of perspective are your children growing up with, in regards to the film industry?

Well I think the reason I've been able to lead such a private life is because I've never flaunted my private life, my fans have respected that. And it makes me able to give more to my professional life, because I have a whole separate life at home. And I'm trying to give my kids as much of a regular life and understanding of the world as I can.

If you could work with any actor, that you have not worked with already, who would it be?

Ricky Gervais! And you know what I want too? I'm obsessed with Gary Shandling and his show. I want to get him on our show.

I know that Alyson was known for pranking everybody on the set, were you ever the victim?

No I think I was more her co-conspirator.

Are there any keepsakes you took from the Buffy set?

Aside from her wardrobe? I think my favorite is that my makeup artist had made a special stake for me with a little bottle of holy water, and to this day I keep it by my bed.

As long as Kristin Chenoweth plays me...

Tell us what you did last summer.

Killed a drifter on the road.

Had you hoped for the rumored Wonder Woman role 10 years ago?

You know, that rumor went around a lot, but Wonder Woman was an Amazon, and due to the fact that I am - shall we say - vertically challenged, it would not have been a good role for me.

Sarah, how is your day going?

My day? well, with mercury in retrograde it didn't out so great. I spilled my cold medicine all over my car which I had just gotten detailed. Then I locked my keys in a place in the car where keys go and are never found again. But now I'm getting to spend my day with fans so it's getting better.

What do you think was Buffy the Vampire Slayer's greatest contribution to to the world? Do you have a favorite "Buffy-ism?"

I think for me the greatest message of Buffy was all about female empowerment, and not just female, but empowerment in general. High school is the scariest part of people's lives, and I loved that we used the monsters of Buffy as a metaphor for the monsters of life. And to not judge a book by its cover. That we are all capable of taking care of ourselves.
Well I think it's the lines that have come now - like I love it when people tweet me "What would Buffy Do" or WWBD, or also "She saved the world, a LOT."

I remember reading that you’re a rare book collector. What are some of your favorite volumes?

My favorite collection that I still am in the process of working on is eventually I want to own every first-edition Dr. Seuss. But I have a complete collection of first-edition Arthur Rackhams, which is one of my prized possessions. And also my first edition Harry Potters.

Also, what's your fav ice cream?

I'm not a big ice cream person, but I love salted caramel ice-cream from Rose Creamery. If anyone wants to send some to me…I'm available to eat it.

Depends who's pronouncing it! But I pronounce it Prinze.

Awww. Cute.... If you had to fight Eliza Dushku in real life do you think you could take her?

I hopefully would not have to fight Eliza, because I like her and consider her a friend. Way more friend than foe. But if we were playing dodgeball, I would definitely pick her first for my team.

Would you ever consider doing anything with Buffy the Vampire Slayer franchise again?

I feel like I still do? I don't think you ever leave that franchise.

Being a young role model for other young girls is a tall order, and you did it so well. Are there any young, up and coming actresses you admire and see as potential role models for young girls now?

I love Jennifer Lawrence. There's this incredibly talented girl who deserves not only every accolade she gets, but is incredibly real and relatable.

The picture of you, Michelle Trachtenberg and Seth Green you posted on twitter has set off a flurry of rumors about a Sunnydale mini-reunion on The Crazy Ones. Which former costar would you most want to work with again?

Oh my goodness, I think the person I am most angling to get on the Crazy Ones is Seth Green. And I will say this: he makes a surprise cameo in an upcoming episode, but I want to get him on for reals.

What's one little thing you love doing in your everyday life ?

Getting my coffee... I get excited at night just thinking about the coffee I am going to have in the morning.

When people talk about the 90s, I always think about you, how do you feel about this?

I worry that they might judge me by my hairstyles? But otherwise I'm ok with it.

Could you explain what Buffy Summers means to you?

You know the same way the audience grew up with her? I grew up with her too. She'll always be a part of me.

Since there's a Mork & Mindy reunion on The Crazy Ones, is there a show you love that you would love to see a reunion of?

Murphy Brown. Hands down. That's like one of my favorite shows of all time... And also a Boston Legal one on the Crazy Ones if it involves William Shatner and James Spader!

Can you sum up your Buffy years, in five words or less?

Not A Chance In BLANK... It was 8 incredible years of making incredible television. It would take 5 HOURS to do it justice.

What three things would you take if you were stranded on a desert island?

My husband, my daughter and my son. I guess I'd have to leave my dog to someone.

Who encouraged you the most throughout your career?

Well I would say there are probably 3 people who've encouraged me the most. The first is my mother, who taught me to follow my dreams. My husband and family for making my dreams come true. And my long-time agent and manager, who's been with me since I was a child and has always believed in me. And David my makeup artist because he's sitting next to me and has been with me for 17 years! I hear him choking because I forgot to mention him, and now he's laughing. David DeLeon makeup.

You're on the forefront of the movement to pass the bill to make it illegal for paparazzi to photograph celebrity children without the parents permission, how do you feel that so many major tabloids such as Just Jared, E! and People are on board?

There are no words to put how grateful I am to JustJared, to People, and to everyone who is joining this movement. Kristen Bell is so incredible because we needed a leader, and she is making the world a safer place for my daughter. My poor daughter is petrified of cameras and doesn't even like taking photos at home because she is scared of large men putting cameras in her face, so the fact that we are getting the support that we are is incredible. I would also like to take this chance to thank the fans who are supporting me by not buying the magazines and not watching the shows that refused to be a part of this. And also to the rockstar Kristen Bell who not only is a heroine, but also kind of my heroine right now.

What is your favorite screwball comedy?

Showgirls.

Which TV show would you like to see do a musical episode?

NOT the Crazy Ones!

Who was a better kisser, Angel or Spike? P.S. any answer other than Spike will be incorrect, but I need you to confirm.

I'm sorry to disappoint. And again my apologies to Jamie [Boreanaz].

Is it hard to work with Robin Williams? It seems like the set would never stop laughing.

I'm not going to lie, there is a lot of laughing. And MAYBE one person might have wet their pants. But I won't say who... But he (Robin) has the best sense of humor.

Did you have any clue where Ringer was heading before it's cancellation?

possibly…

I just wanted to say that Buffy has been a source of bonding among my father, brother, and I (much to the dismay of my mother). We all love strong women and really respected the way you portrayed growth and maturation all while being bad ass. No question here, but you're amazing.

What's wrong with your mom? Why doesn't she watch Buffy?

What was it like being in the Scooby-Doo movies?

It takes a lot to talk to a dog that's not there. I really used my acting chops on that one...

Also, is Robin Williams as good looking in person as he is on TV?

Forget good looking. He is the kindest, most incredible human being. You want to talk about a superhero? He's it.

Still Angel.

This is my cat, Buffy. I catch a lot of flack for naming the cat Buffy, and get called lame, but I just liked you so much, I had to have a Buffy of my own.

By the way, a lot of people have animals named Buffy and it's a very good animal name and I stand behind that.

Have you ever read any Buffy fanfic? How bad/disturbing was it?

I have. And it's pretty incredible. And it's really moving when people take the time to do that kind of thing.

What is the most ridiculous tabloid rumour you have heard about yourself?

Normally I don't read them, but there was a really weird story once about me pulling a hamstring in my butt, it was actually my costumer (who was also named Sarah).

Coke or Pepsi?

Coke Zero. But my children do not drink it. It's all for me. My children only drink scotch from their sippy cup. ;)

Outside of TV and film, whats the most rewarding thing you've ever done?

The answer is my children.

Will you let your kids watch Buffy when they're older or is it weird for you/them to see you on screen?

That's an interesting question. I don't think I'm ready to tackle the thought of them watching. I mean, right now my daughter doesn't even want to watch me on Sesame Street, so I'm going to have to think about that one. Come back to me in a few years.

If you were a muppet, which one would you be?

Miss Piggy! She gets all the great wardrobe. AND she knows Joan Rivers.

What are your thoughts on peanut butter cups?

LOVE 'EM! Positive. All for 'em. Especially in the freezer. I like the mini ones better because I feel like I'm getting away with something.

If you had the opportunity to star as any woman from history, who would you choose?

Neely O'Hara from Valley of the Dolls.

What keeps your hair so soft and supple these days in your busy, daily grind lifestyle?

I think eating healthy and living a healthy lifestyle is the biggest part of that.

What do you think about Twilight?

You know, vampires - people always say to me "how do you feel about these other things copying you?" and you have to remember that vampires were around a LONG time before Buffy. I'm just glad the legend continues.

And, finally... Have you seen the documentary Blackfish?

"Yes."

NLRB's recent significant decisions

The NLRB this week made public a number of significant decisions, most reached in the final days of the term of Member Brian Hayes, which ended on December 16. The Board continues with three members, Chairman Mark Gaston Pearce and Members Richard F. Griffin, Jr. and Sharon Block.

The decisions touch on a variety of issues including social media postings, charter school jurisdiction, backpay awards, the chargeability of certain union lobbying expenses, and an employer’s responsibility to continue dues collection after the expiration of a contract.

Hispanics United of Buffalo
The Board found that the employer unlawfully fired five employees because of their Facebook posts and comments about a coworker who intended to complain to management about their work performance. In its analysis, the Board majority applied settled Board law to the new world of social media, finding that the Facebook conversation was concerted activity and was protected by the National Labor Relations Act. Member Hayes dissented.

Alan Ritchey, Inc.
In a unanimous decision that resolved the last of the two-member cases returned following the 2010 Supreme Court decision in New Process Steel, the Board found that where there is no collectively-bargained grievance-arbitration system in place, employers generally must give the union notice and an opportunity to bargain before imposing discipline such as a discharge or suspension on employees. Member Hayes was recused.

Latino Express
In a decision that will affect most cases in which backpay is awarded, the Board decided to require respondents to compensate employees for any extra taxes they have to pay as a result of receiving the backpay in a lump sum. The Board will also require an employer ordered to pay back wages to file with the Social Security Administration a report allocating the back wages to the years in which they were or would have been earned. The Board requested briefs in this case in July 2012. Member Hayes did not participate in the case.

Chicago Mathematics & Science Academy
Rejecting the position of a teachers’ union, the Board found that it had jurisdiction over an Illinois non-profit corporation that operates a public charter school in Chicago. The non-profit was not the sort of government entity exempt from the National Labor Relations Act, the Board majority concluded, and there was no reason for the Board to decline jurisdiction. Member Hayes dissented in part.

United Nurses & Allied Professionals (Kent Hospital)
The Board, with Member Hayes dissenting, addressed several issues involving the rights of nonmember dues objectors under the Supreme Court’s Beck decision. On the main issue, the majority held that, like all other union expenses, lobbying expenses are chargeable to objectors, to the extent that they are germane to collective bargaining, contract administration, or grievance adjustment. The Board invited further briefing from interested parties on the how it should define and apply the germaneness standard in the context of lobbying activities.

WKYC-TV, Gannet Co.
Applying the general rule against unilateral employer changes in terms and conditions of employment, the Board found that an employer’s obligation to collect union dues under a check-off agreement will continue after the contract expires and before a bargaining impasse occurs or a new contract is reached. Member Hayes dissented.

The Legal Turbulence Facing Amazon’s Drones

News of Amazon’s plans to use delivery drones surprised many, but the fact is that a number of companies are developing drones for commercial uses. However, before any of these commercial drones can take flight, they need to clear a series of legal hurdles, from winning FAA approval to sorting out liability and privacy issues. End of Lifed

As some of you know (and I know you know because you write me angry emails and exasperated twits), Simple Justice hasn't worked well for months now. It takes forever for the posts to load, assuming they load at all.  After trying to find out from my host, GoDaddy, why this is happening, I was eventually told that they had given up on the blogging program I use, stopped doing anything to maintain its efficacy a year ago, and were preparing to "End of Life" their involvement in blogging.

Mind you, this didn't stop GoDaddy from taking my money to use their program, but I digress.

Over the past couple of months, I have been involved in an effort to move SJ to a new platform over at WordPress with a new host. It had a few hitches along the way. My initial efforts involved some of the turnkey opportunities for blawgers, one of which involved spending huge sums of money because their business model is based on dopey law firms who buy into the "every lawyer needs a blawg or will die" vision of the future.

Since this isn't a marketing tool or money maker for me, there was no way I was going to throw thousands of dollars into this hole. My basic premise is that I write and people get to read, if they want, for free. While I am happy to provide the content for my own purposes, if not yours, I am not happy to pay through the nose to amuse readers.

Another wanted me as part of their stable of law blogs, which wouldn't have been so awful except that they quickly reneged on the deal offered when they saw the volume of traffic here.  Reneging isn't something I can live with.

Lacking the mad computer skillz to make this happen on my own, a few people who had significant computer skills and enjoyed SJ offered to lend a hand and make a move happen.  One gave me a lead on the big issues, but was too high on the pay grade to do the dirty work. Another was happy to make the nuts and bolts of a change happen. 

After being well on the way, he suffered some personal problems and, well, disappeared on me. As in, went dark. I grew far more concerned about his welfare than I was about moving this blog. Some things are real, like a good person's well-being, and to this moment, I have no clue whether he is dead or alive. I hope he gets in touch with me soon. I'm still deeply concerned.

It wasn't easy stuff. GoDaddy's system was proprietary, and didn't play nice with anyone else's system. While GoDaddy had developed an export feature to move content to WordPress, they found out that it wasn't particularly "robust," and that my rather extensive content crashed the system. It could handle about 100 blog posts. I had well over 5000. Nobody at GoDaddy anticipated someone as prolific as me.

But when their general counsel explained that I probably wasn't a great choice of people to piss off, they put some developers on the task of creating a means of moving my content. It took a couple of weeks, but they eventually managed to pull it off. It was a decidedly less than perfect solution, as they were able to include my posts and the comments, but they couldn't manage to get the contents to thread (or nest, if you prefer) at WordPress. Bear this in mind later, so no one bitches at me about the comments. It just couldn't be done.

Many people have suggested their hosts, web designers, programs, whatever, to fix the disaster of using GoDaddy. While I appreciated the concern, it wasn't really helpful after the first few thousand suggestions. Most of my griping had to do with prodding GoDaddy to keep SJ working, at least minimally, until a move could be completed.  This wasn't a bleg for suggestions, but deliberate effort to poke GoDaddy by a wee bit of public shaming for their inability to do what they took money to do.

Finally, I was hooked up with a guy who, for a fee, would do what was needed to finish the move. We were on the same page, and although it irks me that I have to pay someone to do the work, I wasn't ready to let SJ die and didn't want to see the content created over the past seven plus years disappear when SJ went dark. But my new guy developed some personal issues that pulled his attention away from making the move happen, I began to think I was a curse to computer people (or maybe computer people were a curse to me?). 

It appears that we're are all getting on the same page now, and provided an alien invasion, healthcare crisis or zombie Armageddon doesn't happen in the next couple of days, I anticipate that SJ will move to its new home.

It's not yet clear to me how easily I will accommodate to WordPress. I know, tons of you have told me how easy it is, but I'm an old dog and new tricks come hard. Heck, it took me a few hours to figure out how to use the "intuitive" wheel of an iPod. Yes, I can be that clueless.

I anticipate that there will a day or two, maybe more, when nothing will appear at SJ. It's not that I've quit or gone fishing. I'm not dead yet. It's just that there will be down time while all this happens, while the internet figures out that I've moved to a new home and redirects you to the right address.

There will be problems in the future as well. Images will be missing. Links will be broken. Formatting will get all screwed up do to differences in coding between GoDaddy and WordPress. It will be annoying to you. Me too, probably more so. But short of going back over the more than 5000 posts and cleaning up the mess by hand, there isn't much I can do to prevent the problems. I am not inclined to spend my time that way. Sorry, but we will all have to suck it up.

I hope this makes things a little clearer for readers, and I apologize for the problems, delays and frustration caused by GoDaddy's sucking. I've been working on it for months now, and I hope we've come to the end of the nightmare. In any event, it's better than being End of Lifed by GoDaddy.

HGTV, LA and Dining Room Tables

I've been watching a lot of HGTV since coming to LA. My favorite shows are House Hunters and House Hunters International. There's also another show I like to watch called For Rent, but only because it makes me angry.

When it comes to apartments/homes, I think living in New York for the past eleven years has made me bitter because there was this whiny broad on For Rent a few nights ago who was looking at a huge place—A HUGE PLACE—and was like, "There's no place for a dining room table..."

B*TCH, YOU'RE LUCKY TO GET A KITCHEN IN NEW YORK.

I hated her.

Now there's some stupid lady on House Hunters who wants a townhouse with a fireplace that she can turn on with a light switch. IT HAS TO BE A LIGHT SWITCH because she doesn't want to bend down and flip a switch on the floor.

WHO DO THESE PEOPLE THINK THEY ARE?

Anyway, I know my LA update is WAY overdue (and truth be told I wrote a long one last week but for some reason it didn't save so I lost the whole thing and I was so angry that I just said, "Ah, f*ck it," and closed the computer instead of rewriting) but to give you a quick update, I AM SO HAPPY HERE. I MEAN, I'M REALLY, REALLY HAPPY. And I think living here and watching HGTV—both of these things combined—has made me realize that New York was just beating me down. I mean, the fireplace lady—yes, she's an idiot. But there's nothing wrong with wanting a dining room table. Why did I get so mad at that lady?

Since being here, at least once a day I ask myself why I have lived in New York for so long. (It's like I had Stockholm Syndrome or something.) CALIFORNIA IS AWESOME. It's like the promised land. It's sunny all the time and there are birds and flowers everywhere. I have space out here. I have a sofa on the patio out here. I HAVE A SOFA OUTSIDE. I haven't seen one rat since I've been here. But hummingbirds? THEY ZIP BY MY HEAD EVERY DAY. I am so happy.

I'm supposed to go back to New York in November, but truth be told, I'm not sure I will.

You Won’t Believe The Damage This Man Caused In His Attempt To Get Off Work Early

We all have days that we just want to end, even The Juice. But we all, er, most of us, that is, power through those days. Not this gent. The damage? You won’t believe it. As reported by The Union Leader:

A former civilian painter who pleaded guilty Thursday to setting two fires aboard the USS Miami could serve about 20 years in prison and have to pay some of the $500 million in damages and injuries. [The victims in the case include the Navy as well as seven firefighters and sailors who were injured during the first fire, which took 12 hours to extinguish.]

Casey James Fury, 24, who worked at Portsmouth Naval Shipyard for two years, faces two counts of arson after he confessed to setting a four-alarm fire aboard the $900 million Los Angeles Class submarine May 23 and a smaller fire in the dry dock at the Kittery facility June 12.

Why? [Just pretend that you don't already know.]

Investigators determined Fury, who worked as a painter and sandblaster, started the two fires because he was anxious and wanted to leave work.

Fury, who has been in custody at Cumberland County Jail since his arrest July 22, and his attorney, David Beneman, signed the agreement to plead guilty Tuesday with Thomas Delahanty, U.S. attorney for the District of Maine, and Assistant U.S. Attorneys Darcie McElwee and James Chapman.

Delahanty said Fury entered his plea in federal court Thursday.

So what’s the deal?

As part of the agreement, Fury could be imprisoned no less than 188 months – just over 15.6 years – and no more than 235 months – about 19.6 years, according to court records.

“The judge accepted it pending on a presentencing investigation,” Delahanty said, adding he anticipates the report to be finished in the next three months.

Here’s what Mr. Fury could have faced (or could be facing if the deal is ultimately rejected by the Judge):

Per federal statute, the first arson charge could keep Fury in prison for the rest of his life, and the second count has a maximum penalty of 25 years.

The Day Tripper Dilemma

If I was hoping to court the legally-ignorant, politically conservative reader, yesterday would not have been a good day for me.  While lawprof Glenn Reynolds, Instapundit, couldn't be bothered to learn about the criminal justice system before opining about how to fix it, he had time to write about how mean I was to him. Not terribly surprising, given how lawprofs tend to be a bit sensitive,

What came of Reynolds' post was a curious thing, a swarm of his followers commenting in his defense. Most were just silly, reflecting the folks who follow his political agenda, and good for some lulz, but they raised an interesting dilemma: lacking education, practical experience or sufficient interest to learn about the substantive issues and problems involved, they ripped me a new one because the post here to which they were directed was the culmination of both numerous posts about Reynolds' disastrous Ham Sandwich Nation "fix" for the criminal justice system and even more numerous posts on the underlying issues.

One commenter made a good point, that my telling them to read a bunch of posts that would provide the substance that isn't in the one post to which they were directed is "weaksauce." He's right. It's not that this matters much, as they haven't come because they have any sincere interest in the subject. If they did, they would already be knowledgeable and wouldn't demand to be taught from the ground up.

But then, to the extent this is anything other than a humorous aside for those of us who are involved in criminal justice issues, it's an opportunity to educate the poor souls who are limited by Reynolds deep commentary (Heh?), and their point that the one post they read wasn't substantive is well-taken. 

So if they can't be expected to read a hundred posts (and it's not really reasonable to expect them to do so), they lack any foundational knowledge on the subject and they're generally disinclined to disagree with their political guru, is there any way to address this gap?

Bear in mind that when the post that made Reynolds cry was written, it wasn't for the purpose of educating his followers but as the coda in the series of posts about his awful ideas to fix the system at the expense of defendants, which in turn was based on innumerable posts here about specific issues and problems with the system.  Way too much to include in one post (and likely one full-length book, for that matter), and completely unnecessary for regular readers here or people who are knowledgeable about criminal law.

Obviously, I can't go back and rewrite the post as Criminal Law 101 for the benefit of Instapundit readers, with lengthy explanations that are obvious to the rest of us.  Perhaps I should have anticipated that Reynolds would get all butthurt about it, write a post with his deepest thoughts, and cause an influx of his readers to come here to salvage his damaged dignity, but I didn't. And even if I had, it would have bored the daylights out of regular readers here. As SJ is neither political nor a plea for popularity among the Instapundit fans, the idea of writing a post in anticipation of the swarm seems outlandish.

One answer could be found on the flip side, if only Reynolds had an appreciation of the more thoughtful legal and practical impact of his politically driven ideas, such that his purportedly well-intended, if misguided, fixes were themselves more substantive, but it's hardly useful to blame the guy who proffers bad ideas for not understanding why his ideas are bad.  If he did, he wouldn't have done so in the first place.

One might expect him, as a lawprof, to try to gain a far better basis of knowledge before going off, but that was one of the primary points of my rant about Reynolds in the first place. And he's playing to a political audience (which is a large part of the problem) rather than to an audience knowledgeable or seriously concerned about criminal law. It's easy to pass off shallow ideas to those who know nothing about the practical impact.

Yet, I missed an opportunity to educate a not insignificant group of day trippers who think they've got a clue because they read tripe like Reynolds' Ham Sandwich Nation. It's a shame to pass up an opportunity like that. It's a dilemma.  I regret not having done a far better job of making use of the opportunity to illuminate.
