Is This The Plot Of Christopher Nolan's 'Interstellar'?

Nolan

The Ford Macleod Gazette, a paper up in Albert, where "Interstellar" is shooting, gives this plot summary for Christopher Nolan's sci-fi thriller. "Set in the future, the movie details the toll climate change has taken on agriculture, with corn the last crop to be cultivated. The scientists embark on a journey through a worm hole into other dimensions in search of somewhere other crops can be grown." So, it's about farming?

James Franco Seduces Emma Roberts In 'Palo Alto' Trailer

In the years since jokes about James Franco's many interests were actually funny, he has done very little to fight back against that public image.

Take the movie "Palo Alto," for example. The movie, directed by Gia Coppola (Francis' granddaughter), is based on the collection of short stories by Franco, and he also has a starring role in the movie as a soccer coach that takes inappropriate interest in one of his teenage players (Emma Roberts).

The first trailer for "Palo Alto" (via Vulture) gives the impression that Franco's short stories have been altered to fit into the format of an ensemble drama with interweaving narratives.

"Palo Alto" premieres at the Telluride Film Festival today, and considering the star power involved, this should see a domestic release sooner or later.

How Bad Ideas Grow Legs

Last January, Instapundit lawprof Glenn Reynolds wrote a short essay that became the darling of many folks who take an interest in criminal justice issues entitled Ham Sandwich Nation: Due Process When Everything is a Crime. To be kind, it was a simplistic rehash of long-time, discredited silver-bullet solutions to complex problems. The only virtue was that it came from Reynolds, who was a law professor and thus credible by definition even though he was dabbling at the edges of an area of law about which he knew nothing.

It was excoriated here. Gideon beat it up at A Public Defender as well. Unlike Reynolds, this wasn't a theoretical exercise for us. We lived with the problems, and would wind up living with whatever inane solution seemed like a cool idea to an academic.  Whereas Reynolds' mantle of scholarly credibility was an asset for others whose interest came from a distance, ours was nuts and bolts, from living with the detritus of bad ideas in the trenches.

Radley Balko took us to task for being critical of Reynolds. The Agitator offered a homily of cooperation, arguing that we ought to work with luminaries like Reynolds rather than saying mean things like their ideas aren't fabulous. After explaining what was horribly wrong with a particular idea promoted by Reynolds that Radley found especially interesting (loser pays in criminal litigation), I wrote:

Radley also questioned by twit why I wasn't more open to embracing the ideas proffered by Glenn Reynolds and Conor Friedersdorf, "And it's probably more productive to engage, persuade new allies than to shun and mock them."  Since I hate to be a shunner or mocker, and I try to be relatively informative as reflected in this response to Radley's query, I look forward to Reynolds and Friedersdorf, our new allies, engaging. Engage away, guys. Your turn.

Of course, I was shunning and mocking, just as Radley said. But then, I had no plan to suck up to Reynolds in an effort to gain him as an ally anymore than I planned to teach a pig to sing. As players in punditry go, Reynolds is a major player,* and he enjoys his importance. He doesn't swim with minnows like Gid and me. At most, he eats us for a snack. Radley may have been well-intended, but didn't really appreciate the pecking order.

Of course, there was nothing to stop Reynolds, either before or after he published his Ham Sandwich essay, from speaking with people who were actually knowledgeable about criminal law, whether that was Gid and/or me, or some other trench lawyers, who could explain why good ideas on paper don't play as well in the courtroom.  But no. He didn't. Since it was his essay being published to enlighten the world, it was his duty to get a clue, and his choice not to.

My point to Radley at the time was the when loud voices with ascribed credibility write something like this, bad things happen. Bad ideas are taken more seriously. Other people will mistakenly assume that Reynolds, lawprof and all, has a clue what he's talking about and his ideas must have merit. After all, lawprofs could never be wrong about lawstuff.  And now that Reynolds had rung the bell, it could not be unrung.

George Will, certainly one of this country's leading conservative intellectuals, heard the peal of Reynolds' bell this week. In an otherwise excellent column on Senators Leahy and Rand's efforts to provide a backdoor to mandatory minimums (which raises the question of why they aren't seeking to end mandatory minimums through the front door, but we'll take it anyway they offer it), Will goes from the sublime to the ridiculous:

The House Judiciary Committee has created an Over-Criminalization Task Force. Its members should read “Three Felonies a Day: How the Feds Target the Innocent,” by Harvey Silverglate, a libertarian lawyer whose book argues that prosecutors could indict most of us for three felonies a day. And the task force should read the short essay “Ham Sandwich Nation: Due Process When Everything Is a Crime” by Glenn Harlan Reynolds, a professor of law at the University of Tennessee. Given the axiom that a competent prosecutor can persuade a grand jury to indict a ham sandwich, and given the reality of prosecutorial abuse — particularly, compelling plea bargains by overcharging with “kitchen sink” indictments — Reynolds believes “the decision to charge a person criminally should itself undergo some degree of due process scrutiny.”

He also suggests banning plea bargains: “An understanding that every criminal charge filed would have to be either backed up in open court or ignominiously dropped would significantly reduce the incentive to overcharge. . . . Our criminal justice system, as presently practiced, is basically a plea-bargain system with actual trials of guilt or innocence a bit of showy froth floating on top.”

While Instapundit is a Big Kahuna on the interwebz and among academics, George Will has a soap box that dwarfs Reynolds. And he's taken Reynolds' "ideas" mainstream, not only crediting Reynolds for his position as an academic, but taking for granted that he's got criminal law chops.  It's unlikely that George checked Reynolds out at Tennessee Law School, where he teaches Administrative Law, Constitutional Law, Law, Science, and Technology, Space Law, Internet Law. See criminal law in there? See anything in his past to suggest even a passing familiarity with the actual practice of criminal law? Me neither.

Yet, I look forward to some fine senators extolling the virtue of a dangerous and hare-brained reform of the law, citing to Glenn Reynolds' Ham Sandwich essays as the font of practical criminal law brilliance.  Because the myth has now been created and George Will gave it legs.

And this is how we end up with monumentally bad ideas being enshrined in law.

* For those who aren't familiar with Instapundit, this from Reynolds' Wikipedia page:

Much of Instapundit's content consists of links to other sites, often with brief comments. (His frequent use of "heh," "indeed," and "read the whole thing" have been widely imitated and are often parodied by other bloggers.) Reynolds encourages readers to explore the wider blogosphere and to fully read articles and posts to which he links.
And that's the foundation for being a major player on the internet.

Headed in-house? Check the pay scale

“So I told him that if he wanted a third child, someone was going to have to go in-house.”
A female lawyer to her colleague, overheard at a Virginia Bar Association meeting

The dream of a more manageable schedule for family may send some women lawyers – or their lawyer partners – into corporate counsel jobs. But a pay disparity persists for women working in-house, when compared to their male counterparts, according to a recent salary survey of nine job categories in U.S. corporate legal departments.

For top level managers in law departments, the pay differential among men and woman was the highest, particularly in bonuses, which were about 40 percent lower for women, according to the survey released on Aug. 22 by ALM Legal Intelligence.

At the managing attorney level down to non-management positions, there was less of a disparity, with median salary, bonus and total compensation figures for women about par for that of men, the survey reported. And in two cases, Senior Attorney and Attorney, female attorneys were compensated at a 7-10 percent higher rate than their male counterparts in corporate legal shops.

For $999, the complete Law Department Compensation Benchmarking Survey is available here.

Resources on the fair pay issue also are available through the Gender Equity Task Force of the American Bar Association. Last spring, top corporate lawyers met for a summit that featured networking by senior women in-house counsel on how to advance in their respective companies, and how to see that female outside counsel get fair credit for their rainmaking abilities.

Lady Gaga Studio: Fashion Fail!

Wow. Where has Lady Gaga been? Well, apparently growing her hair out and getting very old looking! This has landed her a nice spot on the Fashion Fail wall of shame.

Rosie Huntington-Whiteley in ELLE UK October 2013: I'm With Jason Statham For Stability

In the midst of her modeling and acting schedules, Rosie Huntington Whiteley is featured on the cover of the October 2013 issue of ELLE UK magazine.

While donning designer duds from Gucci and Miu Miu for the Mariano Vivanco-shot spread, the 26-year-old actress/model opened up about her relationship with actor Jason Statham and even reveals how she's managed to survive in the modeling world.

Check out GossipCenter’s recap of Miss Huntington-Whiteley’s interview below. For more, be sure to visit ELLE UK!

On her life with Jason:
"Many models are in long-term relationships for stability. Admittedly, not always with great men, but it gives them something to come to, something grounding. That’s how I see my relationship."

On modeling:
"I can see why people think models come across as a little cold. When you start out, you’re so young you don’t have a voice. Everyone just tells you what to do and you can end up abroad in the middle of nowhere, with no one speaking English. It is very lonely… you develop a thick skin to protect yourself. Now I am 26, when I come on a set, I can say what I think and my opinions are noted. I’ve grafted hard to be hard to be here."

On ignoring the social media trolls:
"I read everything on the internet and I got destroyed by it. I panicked. I was unhappy because I was nervous and insecure, so I cut it off. Today I am in a healthier and happier place."

Pranking The Cops?

prank%20funny%20pranks%20crazy.jpg

Pranks are funny. But really, the only person who can prank a cop is ... another cop. Tell it to these folks in Houston. As reported by khou.com ...

Harris County deputies said they were initially called to a home in the 13600 block of Treebank Thursday night after reports of a domestic disturbance.
The deputies said they spoke with a couple who was in the home, resolved the situation and left.
But then, around 7 a.m. Friday, deputies received another call from the home.
When officers responded, they said they found the front door cracked open, so they went inside.
You might not want to ...
... as they pushed the door open, a bucket fell on one of the deputies, and the others were splashed with liquid.
Alright, where are ya?!
The deputies called for backup, explaining that a bucket full of an unknown substance had fallen on them, and they were unsure if there were other traps in the home.
Other deputies and a bomb squad swarmed the scene. At one point, deputies drew their guns and surrounded the home. The bomb squad checked the home for other traps, but found none.
Whoa there. So what happened after all that?
In the end, though, deputies determined that the bucket was just full of water. No one was injured.
And the perps?
The occupants of the home were nowhere to be found, and no arrests were made.
Here's the source.

Streakers Get What's Coming To Them

streakers%20streaking.JPG

Yes sir. These streakers were in for a real surprise when they ran into a police officer while streaking through a neighborhood in Portsmouth, New Hampshire. And they got what was coming to them, which was ... nothing! As it should have been with this truly victimless crime. Per The Union Leader:

In a scene reminiscent of Will Ferrell's run through the neighborhood au naturel in the movie "Old School," a Greenland police officer working a construction detail on Bartlett Street early Monday morning got a surprise when a naked woman ran by him.
Portsmouth police responded around 3:30 a.m., and found a man also out and about without any clothes on. The pair said they were playing strip poker with friends and, as part of losing, had to run around the block in the buff.
When police brought the two back to retrieve their clothes, they found two other people in various stages of undress. The streakers got off with a warning.
Sanity!

Tameka Foster Loses Custody Play After Accident

After Usher’s son nearly drowned in a freak pool accident, Tameka Foster made a quick play at having temporary primary custody. A judge struck down the request, which was more sad than triumphant.

If you know the story, and have any children of your own, it is scary as heck. Usher’s son was swimming at his home when the unthinkable happened. The boy got stuck in the pool drain and was not able to be removed by the woman caring for him. Thankfully, a contractor working at the house was able to pull him free and performed CPR.

That was clearly what saved the boy’s life. By the time paramedics arrived, he was pretty “with it,” and needed to be taken to the hospital for testing to make sure he was alright.

Meanwhile, the boy’s mother apparently freaked out, and filed a motion for an emergency custody hearing. These hearings are pretty typical when something happens to the child in a split custody situation–especially for celebs. We saw some of the same thing for Charlie Sheen and his ex-wife, and others.

So the hearing finally arrived, and Usher and Tameka couldn’t have been more awkward. They both sat awaiting their counsel and apparently refused to make eye contact.

Finally the hearing arrived, and the judge called the event an “awful accident,” and despite Tameka saying the children were in a “dangerous environment,” the case was dismissed.

Along with her issues with the accident, Tameka complained to the court that she was not kept informed about what the children were doing, or even who was caring for them. She said that there were many changes in their lives that she was not made aware of.

Usher claims that he did his best to send her an email about their week, and that she was always kept in the loop.

Overall, this thing is pretty sad. She ended up in tears and being denied any changes to their custody arrangement.

Sad case. We’re just glad the boy is alive.

Is Batman Legally Dead?

On this episode of Lawyer2Lawyer, J. Craig Williams chats with Entertainment Lawyer Michael Baroni and superhero-law expert James Daily about the ending of The Dark Knight Rises. Proceed with caution – there are spoilers ahead! The city of Gotham sees Batman die at the end of the film. Does that mean that Bruce Wayne is legally dead, as well? And if so, who gets the batmobiles? Legally speaking, Warner Brothers’ design patent on the batmobile will run out, as will their patent on the story. Will another company fill the role and bring back Batman?

• Baroni has been watching the Batman films since he was a kid and continues to be an enthusiast. Batman fan by night, he works as general counsel for Palace Entertainment by day. He is also a member of the Orange County Bar Association.

• Daily is co-author of the book The Law of Superheroes and the blog Law and Multiverse. Both publications discuss the hypothetical legal ramifications behind comic book characters and their powers. When James isn’t meticulously analyzing the law of comic books and characters, he works in intellectual property and patent law.

Tune in for, what Baroni describes as, the perfect “legal cocktail chatter” on the legalities behind Batman’s death, what he left behind, and the chances of a resurrection of one of America’s most beloved comic-book characters.

Special thanks to our sponsor, Clio.
