Should a Chimpanzee Have Human Rights?

If it’s not legally a human, it’s a thing. But animal rights advocates argue these alternatives fail to recognize that there are many cognitively complex species who deserve to be treated as people. The Nonhuman Rights Project is planning to file a writ of habeas corpus on behalf of a chimp to grant her the right to bodily liberty. This will release her from the cage she is currently living in, and the project will have her admitted into a cageless sanctuary. Steven M. Wise, president of The Nonhuman Rights Project, has been researching and planning this case for 20 years.

Steven M. Wise has been practicing animal protection law nationwide for for the past 30 years. He was the first professor to teach animal law at Harvard University and is still teaching animal law courses all over the world. He has published four books on the matter, including Rattling the Cage – Toward Legal Rights for Animals.

On the May edition of Workers’ Comp Matters Host and Attorney Alan Pierce talks with two highly-respected guests in the field of workers’ compensation attorneys. ‘X-Men: Days of Future Past’ Trailer (Video)

The first ‘X-Men: Days of Future Past’ trailer has hit the Web! Brian Singer directs an all-star cast — Hugh Jackman, Jennifer Lawrence, Halle Berry, Patrick Stewart, Ian McKellen, Anna Paquin, James McAvoy, Michael Fassbender, and others, both returning cast and newcomers — in the highly anticipated superhero movie.




This glimpse of the upcoming movie, the latest installment of the Marvel comic book franchise, has fueled excitement. It is a sequel-prequel to the previous X-Men movies — ‘X-Men: The Last Stand’ and ‘X-Men: First Class’ — and as such, it brings back the beloved mutant characters from both movies.

The trailer offers much that its intriguing as it finds Hugh Jackman (picture above) as The Wolverine, along with the mutants as they confront challenges in two different time periods. It serves to bring together a staggering number of characters all in one movie.

It all comes about when Professor X (Patrick Stewart) and Magneto (Ian McKellen) send Wolverine back into the past so that he warn their younger selves — portrayed, respectively by James McAvoy and Michael Fassbender — of what can happen. The mastermind of this disaster to come is the villain Bolivar Trask, portrayed by Peter Dinklage (‘Game of Thrones’). The stakes couldn’t be higher, as he has created the Sentinels, gigantic robots whom he has programmed to destroy all of the mutants.

Also generating much enthusiasm is the return of the original director Brian Singer, who first rose to fame with ‘The Usual Suspects.’ He directed the 2000 movie ‘X-Men’ as well as ‘X2′ and ‘X-Men First Class.’ Thirteen years after the start of the highly successful series of movies, he is still on board directing a script by Matthew Vaughn and Simon Kinberg.

The movie also costars Nicholas Hoult, Ellen Page, Fan Bingbing, Daniel Cudmore, Booboo Stewart and others. It opens in theaters on May 23, 2014.

I went to the premiere on Tuesday and it was the coolest thing ever. First, the movie is AMAZING and Chris Evans is a superstar. Second, there were so many damn people there it was insane. I have been to movie premieres in New York before and they were nothing like this. I mean, they closed down Hollywood Boulevard. I would've taken photos to show you, but the invite said to leave phones in the car. But here's a photo of me in my cool Captain America 3D glasses:

Alec Baldwin and Miley Cyrus Interrupt Edward Norton’s SNL Monologue! (Video)

Poor Edward Norton could not get through his Saturday Night monologue without interruption by Miley Cyrus, her tongue and her tour announcement! Alec Baldwin showed up to give him hosting advice! It was a crowded stage!




What’s a SNL host to do? In this case share the stage! The 44-year-old Edward Norton explained that it was his first time hosting the show, and that executive producer Loren Michaels had first asked him to host in 2000. He said he told Michaels he was a Method actor and he needed time to prepare. How much time? He said he needed 13 years!

Veteran host Alec Baldwin wanders in to offer some advice. He gave him the Alec Baldwin SNL Warmup for Dramatic Actors. After spoofing dramatic turns, and facial cues The actor, whose Oscar-nominated role as a reformed skinhead ‘American History X’ solidified his fame, then revealed himself to be capable of the comedic impressions Baldwin asked him to do, including Woody — he did both Woody Allen and Woody Harrelson.

Miley Cyrus just happened to wander in wearing a midriff-length white T-shirt and dark skirt. One might be forgiven for saying she “came in like a wrecking ball,” as that is pretty much what she did! She said, “Real quick I’d just like to announce that I’m about to go on tour.” After the applause died down, she then offered “Miley’s three rules.” Have fun, keep your energy up and stick your tongue out. Oh, yes, she demonstrated that last tip.

But mainly she announced her tour, just three weeks after her dual hosting and musical guest gig on the show. Alec Baldwin, not to be outdone in shameless self-promotion, plugged his new talk show on MSBC, not once but twice.

Later, Miley Cyrus Tweeted to her 14+ million followers about her tour: “I’m gooooing on tooooooour!! #Bangerz2014Tour”

Thus went Edward Norton’s debut hosting of ‘Saturday Night Live,’ after his 13 years of prep! See the replay below!

Former tax court judge Sheryl Ramstad joins Krieg DeVault

Former Minnesota Tax Court Judge Sheryl A. Ramstad recently joined the Twin Cities office of Krieg DeVault. The hire was announced today.

She will work in the firm’s governmental affairs, business and health care practice groups.

Ramstad served on the tax court for 11 years before resigning in September of last year. From 1996 to 2001 she served as Commissioner of the Minnesota Department of Corrections under Gov. Jesse Ventura. She also spent 14 years as a partner with the former Minnesota law firm, Rider Bennett, and prior to that was an Assistant United States Attorney.

She also is a past president of Minnesota Women Lawyers, the Hennepin County Bar Association and the Minnesota State Bar Association.

“Krieg DeVault is a wonderful fit for me,” Ramstad said in a statement announcing her hire. “The firm has a long-standing reputation for outstanding client service, and I look forward to being part of the established team of professionals who work in the Twin Cities Office, as well as assisting them in the growth of the firm’s clients and business partners.”

Ramstad is a graduate of the University of Minnesota. She graduated from the University of North Dakota School of Law (with honors) and was a member of the Order of the Coif, as well as an Editor of the Law Review. In December, Ms. Ramstad will graduate from the University of Minnesota School of Nursing where she is currently completing her Masters of Nursing degree.

Krieg DeVault has five attorneys in its Minneapolis office located in the RBC Plaza in downtown Minneapolis.

Dax Shepard Reveals Low-Budget Wedding with Kristen Bell on “Jimmy Kimmel Live”

He’s a man madly in love, and Dax Shepard couldn’t shut up about his beautiful wife Kristen Bell while chatting with Jimmy Kimmel last night (October 28).

The “Without a Paddle” star declared that his Beverly Hills County Clerk’s Office nuptials on October 17th made him the “luckiest man in America.”

Shepard explained, "It was just Kristen and I at this lonely courthouse so they brought us this cake afterwards."

Apparently the cake had “The World’s Worst Wedding” written on it- “How many people can say they threw 'The World's Worst Wedding?'" asked Dax.

Of his experience at Kimmel’s own wedding over the summer, Shepard stated, "There were helicopters overhead. It felt like an episode of M*A*S*H," he recalled of Kimmel's big day. Not that I was counting your money, but I was counting your money at this thing. It was flying out the windows. They were setting it on fire at this place! So we went to the Beverly Hills Courthouse, and all in, with fuel to get there, $142 out the door."

‘Mr. Peabody & Sherman’ Trailer (Video) with ‘Modern Family’ Star Ty Burrell and Max Charles

Watch the first trailer for ‘Mr. Peabody & Sherman.’ The new 3D computer-animated movie features iconic characters from ‘The Rocky and Bullwinkle Show,’ the genius dog and the human boy, voiced by ‘Modern Family’ star Ty Burrell and child actor Max Charles respectively.




The new comedy from from DreamWorks Animation directed by Rob Minkoff (‘The Lion King’) marks the first time these 1960s Saturday morning cartoon favorites have graced the silver screen. As in the TV show, Mr. Peabody — “the world’s most amazing dog” — is also the smartest living being of any kind in the world. But this time around, Rocky is not a pet; he has adopted the human boy Sherman as his son.

Ty Burrell, who portrays as Phil Dunphy in the ABC hit sitcom ‘Modern Family,’ makes his debut as a voice actor, in his portrayal of MR. Peabody, as does Max Charles as Sherman, who has previously been seen as the young Peter Parker in ‘The Amazing Spider-Man.’

As seen in the trailer, the movie is a departure from the original ‘Rocky & Bullwinkle’ cartoon. Bullwinkle, the moose, does not appear, nor does Rocky the squirrel. The longtime adversaries of Rocky & Bullwinkle — the Cold War era spies Boris Badenov and Natasha Fatale — also do not appear.

Instead, the movie is a takeoff from the ‘Peabody’s Improbable History’ segments of the original show; Mr. Peabody and his time machine, the WABAC machine. With a time machine and Sherman’s desire to impress his friend Penny (Ariel Winter), an unplanned trip back to the past is inevitable. Along with that, the inevitable rewriting of history which must be corrected with yet another trip back to the past. But it’s all in good fun, as we see cameo appearances from the likes of Leonardo Da Vinci, ancient Greeks and Egyptians, the Founding Fathers and others.

Additionally, the movie features the voices of Mel Brooks, Stephen Colbert, Stanley Tucci, Leslie Mann, Patrick Warburton, and Allison Janney. ‘Mr. Peabody & Sherman’ opens in theaters on March 7, 2014. The first trailer is below!

Justin Bieber Debuts ‘Recovery,’ His New Song, as “One of the Most Important’

Justin Bieber has released a new song, ‘Recovery,’ as part of his “Music Mondays” series. The R&B slow jam was trending on Twitter and topped iTune charts around the world upon its midnight release. Hear the song and its emotionally raw lyrics, which are sparking much discussion.




This latest “journal entry” as the teen music superstar calls these songs explores the aftermath of the dissolution of a relationship. The 19-year-old Justin Bieber Tweeted “It’s here. One of the most important songs to me I’ve ever written. #Recovery . Hope it helps you!”

The song samples the hit single, ‘Fill Me In,’ by Grammy-nominated British singer-songwriter Craig David, who Tweeted his solid endorsement, “So many great memories flood back when hearing this guitar riff. Well done @justinbieber sounding great.”

The single cover art for ‘Recovery’ which was previously released on Twitter is stark, unadorned; a white background with a purple cross, stylized like the Red Cross logo, which gives it a clinical look. The lyrics themselves are less poetic and more to the point, a sort of blank-verse confessional from an unnamed “I” to an unnamed “you,” giving the listeners the chance to eavesdrop.

As Justin Bieber himself has invited us to make autobiographical assumptions, we could speculate that he is singing about his former girlfriend and fellow music star, Selena Gomez. With such lines as “….First, I’ll acknowledge / All trust has been broken / A successful recovery / I pray for us at night…” he admits culpability, and later even more explicitly, “…I know that I caused a problem / Know that I left you / Pushed you far away…” even as he asks for a second chance.

His manager, Scooter Braun Tweeted “One of my favorites & from an honest place. Very Craig David too. @justinbieber #Recovery .”

Previous releases in the Music Mondays series have been “Heartbreaker,” “All That Matters” and “Hold Tight.” The weekly serialization — slated to last 10 weeks in total — culminates with the Christmas Day release of the 3D concert movie, ‘Believe,’ which takes its title from both the album and the world tour.

eFiling will be down for maintenace this weekend

The Minnesota Judicial Branch says the efiling feature of the court’s eCourtMN initiative will be down this weekend.

The branch says, first time eFilings into existing cases may not be available from 5 p.m. Oct. 25 through an unspecified time Monday, Oct. 28. The branch is performing an upgrade to the Minnesota Court Information System.

The MNCIS calendar function was also down for a week earlier this month. The branch said the problem occurred because of a software upgrade.

Washington's sexual orientation discrimination amendment is not retroactive

The Washington State Supreme Court held today that a sexual orientation discrimination amendment adopted in 2006 is not retroactive.

The court also concluded that conduct that took place prior to the amendment is admissible background evidence to prove the discriminatory nature of certain conduct occurring after the amendment.

Loeffelholz v. Univ of Washington (Washington 09/13/2012)

Loeffelholz sued under the Washington Law Against Discrimination (WLAD) claiming discrimination based on sexual orientation. WLAD was amended in 2006 to include sexual orientation as a protected class, and Loeffelholz alleged several pre-amendment acts and one post-amendment act.

The Washington Supreme Court held that (1) the WLAD amendment is not retroactive and the pre-amendment conduct is not actionable as it was not unlawful when it occurred, and (2) the post-amendment allegedly discriminatory comment is arguably similar enough to the pre-amendment conduct to survive summary judgment.

Loeffelholz alleged that her supervisor between 2003 and June 2006 maintained a hostile work environment based on sexual orientation. This was prior to the WLAD amendment. Loeffelholz also alleged a single act of discrimination by this supervisor after the WLAD amendment.

The court's findings:

(1) Pre-amendment conduct is not actionable. Retroactive application of the amendment would violate the employer's due process rights. The plain language of the amendment and its legislative history indicate only prospective application.

(2) Pre-amendment conduct is admissible as background evidence to prove why the post-amendment conduct is discriminatory.

(3) The post-amendment conduct was a single statement by Loeffelholz's supervisor, who was about to be deployed to Iraq, that he was "going to come back a very angry man." The court found that a reasonable jury could infer that this comment was a natural extension of pre-amendment conduct - the supervisor's dislike of lesbians and his anger management problems as illustrated by his comments that he had a volatile temper and kept a gun. This is enough to preclude summary judgment.
