On the April edition of The Paralegal Voice Vicki Voisin hosts Charlsye Smith Diaz, a professor of technical writing at The University of Maine, who got her start as a paralegal.

Diaz and Voisin met through The National Association of Legal Assistants (NALA) and there they decided to co-author a book, The Professional Paralegal: A Guide to Finding a Job and Career Success. The book was written with both beginning and experienced paralegals in mind.

Robin Thicke Suggests Blurred Lines Is "Great Art" For "A Feminist Movement"

As Helen Reddy said, “I am woman, get me naked hear me roar!”

This week, Robin Thicke told Today hosts Savannah Guthrie and Matt Lauer that despite allegations of his hit, Blurred Lines, containing themes of rape and degradation of women, it’s actually an anthem of female empowerment!

Robin explains:

"That’s what great art does. It's supposed to stir conversation, it's supposed to make us talk about what's important and what the relationship between men and women is, but if you listen to the lyrics it says 'That man is not your maker.' It's actually a feminist movement in itself."

He forgot to mention the lyric “I'll give you something big enough to tear your ass in two,” and all the references to the woman being addressed in the song as a “bitch.”

But we can’t deny, the beat is CATCHY!

Robin continued:

"When we made the song, we had nothing but the most respect for women.... We were just trying to make a funny song and sometimes the lyrics get misconstrued when you're just trying to put people on the dance floor and have a good time, but we had no idea it would stir this much controversy. We only had the best intentions.... It’s saying that women and men are equals as animals and in power. It doesn’t matter if you’re a god girl or a bad girl, you can still have a good time.”

Even if we're not entirely sure the line "I'm a nice guy, but don't get confused, you gettin it" is something the suffragettes would have signed off on, at least Robin was willing to address his controversy head on.

We hope Matt Lauer was taking notes! LOLz!!!

Third Circuit rules business cannot challenge birth control mandate

[JURIST] The US Court of Appeals for the Third Circuit [official website] ruled [opinion, PDF] Friday that family-owned, profit-making businesses cannot challenge the new federal health care law's birth control mandate on religious grounds. Conestoga Wood Specialties, a Pennsylvania company with 950 employees, maintains a policy not to support "anything that terminates a fertilized embryo." The company objected to the provision of the mandate requiring employers to provide contraceptive coverage to employees, including the "morning-after pill," known as Plan-B Onestep...

HGTV, LA and Dining Room Tables

I've been watching a lot of HGTV since coming to LA. My favorite shows are House Hunters and House Hunters International. There's also another show I like to watch called For Rent, but only because it makes me angry.

When it comes to apartments/homes, I think living in New York for the past eleven years has made me bitter because there was this whiny broad on For Rent a few nights ago who was looking at a huge place—A HUGE PLACE—and was like, "There's no place for a dining room table..."

B*TCH, YOU'RE LUCKY TO GET A KITCHEN IN NEW YORK.

I hated her.

Now there's some stupid lady on House Hunters who wants a townhouse with a fireplace that she can turn on with a light switch. IT HAS TO BE A LIGHT SWITCH because she doesn't want to bend down and flip a switch on the floor.

WHO DO THESE PEOPLE THINK THEY ARE?

Anyway, I know my LA update is WAY overdue (and truth be told I wrote a long one last week but for some reason it didn't save so I lost the whole thing and I was so angry that I just said, "Ah, f*ck it," and closed the computer instead of rewriting) but to give you a quick update, I AM SO HAPPY HERE. I MEAN, I'M REALLY, REALLY HAPPY. And I think living here and watching HGTV—both of these things combined—has made me realize that New York was just beating me down. I mean, the fireplace lady—yes, she's an idiot. But there's nothing wrong with wanting a dining room table. Why did I get so mad at that lady?

Since being here, at least once a day I ask myself why I have lived in New York for so long. (It's like I had Stockholm Syndrome or something.) CALIFORNIA IS AWESOME. It's like the promised land. It's sunny all the time and there are birds and flowers everywhere. I have space out here. I have a sofa on the patio out here. I HAVE A SOFA OUTSIDE. I haven't seen one rat since I've been here. But hummingbirds? THEY ZIP BY MY HEAD EVERY DAY. I am so happy.

I'm supposed to go back to New York in November, but truth be told, I'm not sure I will.

Chat with Two National Leaders of the Workers' Comp Bar

On the May edition of Workers’ Comp Matters Host and Attorney Alan Pierce talks with two highly-respected guests in the field of workers’ compensation attorneys. The first half of the show he will speak with President of the Workers’ Injury Law and Advocacy Group (WILG) Cathy Stanton regarding proposed Federal legislation reforming the law regarding the Medicare Set-aside requirements as well as the recently enacted SMART Act.

As a parent, you want to make sure your kids can handle themselves when they are on their own. This is not how you do it. As reported by swflcrimestoppers.org:

Southwest FloridaCrime Stoppers is asking for the public’s help identifying two women who utilized the innocence of several young children to commit a felony crime earlier this week.
According to deputies, two adult females, and five young children, entered the Gymboree store at 20350 Summerlin Road, Fort Myers, on Tuesday evening, July 23, to go shopping. When they approached the check out counter, another female was there speaking with one of the employees. When the suspect became engaged in that conversation, one of the children swiped the victims wallet, which was left on the counter. Once the stolen wallet was in hand, the troupe quickly exited the store and left in a white colored vehicle. The victim’s phone was also taken, but was found shortly thereafter along the roadside near Tanger Outlets.
And if you're thinking that the adults aren't that sharp, well ...
Within an hour, credit cards left in the wallet were used twice at Pier One Imports for charges of more than $200, as well as the Foot Locker at the Edison Mall, charging up two initial fraudulent purchases for roughly $400. When the suspect and her children, ranging in age from 5-12, returned to make a third purchase for approximately $600 in shoes, the card was declined, as the victim had reported her credit cards as being stolen.

As a result of a barrage of Crime Stoppers tips received today, the primary suspect in this case has been positively identified as Shanice Stewart, DOB 2/13/88. She now faces charges of felony grand theft and possible other charges. Stewart is a registered convicted felon with an extensive rap sheet, dating back to her first felony for grand theft auto at age 14. Since then she’s been jailed in Lee County for a long list of charges including burglary, aggravated assault, robbery, dealing in stolen property, multiple counts of theft, among other charges. Stewart has also spent jail time in both Collier and Manatee Counties.

Baby North West Photos Sell for Over $3 Million?

Honestly, I still can’t believe that they named their baby North West. And I wont believe it until that magazine cover comes out with the pic on front to prove it!

The photos of baby North West have yet to be sold and Kim and Kanye think that they can get top dollar for them. They have even turned down a $3 million offer! That is insane! Honestly, I hope they donate the money they make off their kids pics to a children’s charity or something cause that is just gross.

 

Uggh. Angelina and Brad raked in a reported $15 million for the photos of Knox Leon & Vivienne Marcheline Jolie-Pitt, another $4.1 million for Shiloh and $2 million for Pax. But of course they also reportedly donated it to charity.

Jennifer Lopez got a whopping $6 million for her twins. Granted everyone is dying to see Kim and Kanye’s baby so I can imaging they will get a pretty nice price. Or they can keep it classy and share the photos like normal people. Ha!

Radar Online reports:

“Kanye was up for taking Kim to one of Beyonce’s shows. Her Mrs. Carter Show World Tour was at Staples Center June 28 and July 1 and Kim was definitely ready to get out. It was Kris who talked her out of it because there is no way Kim would not have been seen and photographed and that would have driven down the price on the official photos.”

Wow that is just sad, if it is true of course. I mean, I’ve been a new mom and I wouldn’t choose to go out to something like that just yet – but to NOT do it because of money – when you are LOADED? that is why I think Kris Humphries didn’t fit in – he called them out on their BS. Throwing Kourtney’s coupon book on the roof was mean, but he had a point – she is a millionaire! get over yourself!

Kristen Stewart Paris Fashion Week: Fashion Fail!

So she isn’t exactly known for her outstanding choices of attire, but this one is just horrendous. She showed up to an event at Paris Fashion Week looking like a back-up dancer to an old Madonna video. The pic below is not the one in question, but is ugly anway.

 

It’s one thing to try to be high fashion, and it’s just another to get dressed while you’re high. I’m not sure which one she was attempting, or both, but it’s terrible.

It looks like she threw on leggings, a pair of bloomer undies, and an old lady’s bra. This is something that even the Twi-hards would have trouble forgiving. I’m sure some real lip-biting was going on when she tried it on, and maybe she was distracted from the out-of-touch look.

She needs to give back her grandmother’s lingerie, and seriously put on a pair of jeans and tank for goodness sake.

Rihanna Fans Throw Food (VIDEO) After Late Start

You know the drill. Rihanna stays out late before a show drinking and partying, sending outrageous tweets, and enjoying being a major star. But, oh wait, she has a show to do the next day!

This has happened at least half a dozen times in the last month or so. Rihanna is simply not prioritizing her shows. This isn’t some spammy hater trying to pass judgement off on her. This is the truth.

But one fan apparently decided they had enough of the waiting and took it upon themselves to teach her a lesson — elementary school style!

RadarOnline reports that a fan chucked some food at RiRi after she made them wait an ungodly amount of time for the show to start.

Multiple tweets have been sent out this summer complaining about how she is not really putting her all into her shows and that she is always late. People are pretty pissed about it.

Different things started to fly onstage at a recent concert in Manchester, including a bag of chips. When she saw it, Rihanna said:

“There’s a good crazy and there’s a bad crazy. When you throw sh*t up here, that’s an epic fail…I swear to god, cut that sh*t out. Really, chips? Chips though?”

So she was pretty upset herself. I guess it’s not quite as bad as someone grabbing her a few months ago. That person earned a microphone smack to the head.

I hope Rihanna doesn’t start to fall out of the good graces of her fans. She has been doing really well after finally getting rid of Chris Brown. I just hope she doesn’t screw things up for herself now that she is out partying all by herself.

Kate Bosworth and Michael Polish: Cute Couple at LAX

Glowing in each other's company, Kate Bosworth and fiancée Michael Polish arrived at LAX Airport in Los Angeles on Monday (July 29).

Officer Safety and Second Hand Smoke

Via John Wesley Hall at Fourth Amendment, a decision out of the 10th Circuit that puts an end to the pressing question of whether second hand smoke presents a sufficient justification to circumvent the 4th Amendment and enter a home without a warrant.  Lest you think this is too ridiculous to be worthy of consideration, bear in mind this is on appeal, the district court having denied suppression.

In United States v. Mongold, Special Agent Ashley Stephens (who apparently is male) of the Bureau of Alcohol, Tobacco, and Firearms (“ATF”) was investigating Claudia Moore, whom she knew to be a felon from prior dealings, for drug dealing. After conducting observations, she, together with three other agents, went to Moore's apartment to conduct a "knock and talk," since she lacked probable cause to get a warrant.

Aside: For those unaware, a "knock and talk" is a means of circumventing the warrant requirement by relying on submission to the shield, lies, fear and the possibility that the agents might either see or cause something to happen to give rise to an exception to the warrant requirement that would allow them to enter a home. And yes, it's been held to be perfectly lawful since anyone, cop or Fuller Brush salesman, can knock on your door and say "hi." Or scream "police", as the case may be.
According to the testimony, Stephens heard "scurrying and shuffling" inside the apartment upon her knocking on the door, "which immediately caused us concern." A male voice asked who it was, and after he responded "police," there were "loud movements" and a "short delay" before Mongold opened the door. That's when the bad stuff happened.

After the delay, Mr. Mongold, who had been living in the home for several months, opened the door. Agent Stephens smelled marijuana and recognized what he believed were prison tattoos on Mr. Mongold. Agent Stephens asked for Ms. Moore. Mr. Mongold told him that he would go get her and turned to walk to the back of the house to find her. The officers followed him inside even though they did not have permission to enter the house.

Once inside, they saw ammunition. Knowing that Moore was a prior felon, possession of ammunition was a crime, and it went downhill from there. Mongold, Moore and her two adult children subsequently consented to a search of the place, which found drugs and guns. 

The defendant moved to suppress before the district court, based on the initial warrantless entry. The government's argument below was that the smell of marijuana, combined with the "prison tats" on Mongold's arm, suggesting that he too was a felon, created a justifiable fear of officer safety, which allowed for Stephens to enter for a protective sweep. The court below also held the entry justified under exigent circumstances to preserve evidence.

The Circuit wasn't as impressed.  While the court acknowledged that the smell of marijuana is accepted as a basis to believe there is pot inside, it merely gives rise to a belief that it's basic possession of marijuana.

Based on the foregoing, if marijuana possession is the only crime for which the officers in this case had probable cause, the exigency exception for destruction of evidence should not apply because marijuana possession is not a serious crime.

But that wasn't the only argument.  There remained their deep concern for the safety from the smell (yes, I'm being facetious calling it "second hand smoke," because it's unclear whether the smell is smoke or fresh pot, and the opinion really has nothing to do with the second-hand smoke aspect in any event).

At the suppression hearing, Agent Stephens argued that he feared for his and the other officers' safety because the home's owner, Ms. Moore, was a known felon, and he suspected Mr. Mongold was a felon as well, based on his "prison tattoos."

Officer safety is not an alternative ground to affirm because the first element of the test is dispositive. The Government presented no evidence that the officers had "reasonable grounds to believe that there [was] immediate need to protect their lives or others." Before entering the home, the officers had not seen a weapon or any other indication of heightened danger.

Even the use of cool active verbs ("scurrying"), curious descriptors ("loud movements") and expressions of deep concern reflecting both the terrible, life-and-death dangers of conducting a "knock and talk" to circumvent the Constitution, didn't sway the court.  Instead, the court reached the conclusion of remarkably wisdom:

They could most easily have protected the officers' safety by leaving Ms. Moore's home, not by entering it.

An idea so radical, so outlandish, that it never occurred to either the agents or the prosecutors: walk away. While this might make for good fodder to be chiseled into the lintels over courthouses everywhere, the bad news is that the opinion, while persuasive, is not precedential:

This order and judgment is not binding precedent, except under the doctrines of law of the case, res judicata, and collateral estoppel. It may be cited, however, for its persuasive value.

This, of course, means that the next time a second-hand smoke case arises, the district judge may not be willing to adopt such a radical concept as expecting the agents to walk away rather than conduct a warrantless search of a home after smelling marijuana or seeing prison tats, because they're very scary to agents.

And don't discount the possibility that if the odor was of burning pot, the agents would be authorized to break down the door to protect themselves from the second hand smoke. Truth is, this opinion doesn't preclude such a holding at all. It could still happen.

Someone posted this on Facebook and I find it so annoying.

Like, what? We're all just a bunch of bumbling idiots?

Here's my response:

No, no, no.

I don't push doors that say "pull" because I can read.

I don't explain why I'm laughing because I don't have to explain myself to anyone.

I don't walk into a room and forget why I went there because I'm not an idiot.

I don't count on my fingers because I'm smart enough to do it in my head.

I don't hide my pain from anyone because my feelings are valid and if I'm hurting, you'll know it.

I say it's a long story because some things are complex and dumbing them down doesn't serve anyone.

I cry a lot because I feel both pain and joy and it's awesome.

I don't care about people who don't care about me because I am not a doormat and I have worth.

I don't try to do things before the microwave beeps because I don't rush around the kitchen like a moron EVER.

I listen to you when you don't listen to me, but I won't do it for long so you better start listening.

And, yes, a hug can be nice, but showing me some respect is even better, so quit embracing me like a child and look me in the eye because YES, I AM A WOMAN!
